In all seriousness, this is the Gators third arrest/incident since their BCS National Title, as they already released a Defensive Back, as well as backup QB Cam Newton transferred due to Dell's "Five Finger Discount" Laptop Procurement Program...

Actually, this is the first Gator arrest since winning the BCS MNC....

Newton and the Hogtown Strangler were arrested during the season well before UF even made their case for the BCS game...

What stinks is by law if a woman is intoxicated, agrees to sex and the next day regrets it, she can say she was raped.

Now you ask, how do you avoid this? You have to have her sign a waiver that shows she agrees to the sex and is in not inebriated(even though she may be). This has to be signed before you start kernal angus or play just the tip.

Now that I think about it, this is how I see how this situation played out.
Carl may have gotten a little too freaky on their first encounter(i.e the shocker or the angry pirate) and it kinda took her by surprise. She went back two other times to test it again because she wasn't sure about it. It hurts allot but she was oddly pleasured by such a foul gesture. This young lady couldn't come to terms with the idea that she had o-lineman mitts up the old dirt road. After three mudding trips, she decided that the freakiness wasn't for her and decided to get the restraining order due to Carl flashing the shocker symbol to her at her sorority house when he brought her flowers.

Fast forward : Poor Carl gets on a bus to head to Organic Chemistry and is studying up for his first exam. Carl smashed his ring finger in his apple red Chevy on 22's the night before so he has the trainers wrap the finger in a bent position. He is on the bus reading and simply holding the book. The lady in the back of the bus, sees the shocker symbol again and flips out. This is when she calls the police.

That’s how I see how this happened. A big misunderstanding

I used to be all for tort reform; now, I'm not really impressed. FLA reformed its tort laws several years ago, capping med/mal damages, creating several obstacles for plaintiffs, etc.

What have we seen as a result?

Health ins. premiums continue to escalate at a brisk pace (if not skyrocket);

Doctors still jumping ship like the Pied Piper's mice--especially OBGYN's and surgeons (i.e.--shortage of physicians);

Health care costs continue to escalate;

The attorney section in the yeller pages remains the fattest section in the book, with plaintiff's lawyers on the covers (front & back), the spine, magnets, stickers, page tabs, etc. not to mention TV ads, radio, billboards, and on and on....;

In other words, tort reform seems to have made things worse; perhaps in its best possible interpretation, it simply slowed down the rate of deterioration of matters, which begs that age old, perpetually, intellectually-provocative question:

WTF???

...and that my friend, i's exactly why I think Carl Johnson is completely innocent of any wrong doing whatsoever.

I'm not amused by any of this. On one side of the coin we have a young man accused of rape; on the other a young woman who has allegedly been raped. There can be only three possibilities. It's all true; none of it's true; only part of it's true. Either way, no matter how it all comes out, if he's acquitted, if he's proven guilty (should it come to that) there well always be a question. It's lose/lose for both of these kids. Sad.

I must admit, I can't help but be suspicious. As already asked, why go back to the guy TWICE, especially after the 1st alleged occurrence? Then, there's his violation of the TRO. Now, did I get this right? He violated it when he got onto the same bus she happened to be on? U make the call. Is it coincidence or stalking? For my part, when I was in college, I can't tell you how many busses I got on, and could have told you who was on their before boarding. I'm not psychic; doubtless neither is he.

Until witnesses and evidence are brought to bear (Hospital records anyone?), it's anyone guess.

In a petition to obtain a temporary restraining order against Florida offensive lineman Carl Johnnson last week, a former girlfriend claims Johnson date-raped her on three occasions last fall and physically and emotionally abused her for months.

FWIW, I agree with the rest of what you wrote. The burden of proof for a temporary restraining order is incredibly low. My TRO against TE is currently pending. ;-)

As I stated previously, she may have just made the whole thing up and given that she returned to a fellow who presumptively raped her twice, I'm more likely to believe his version of events at this point than hers. Still, I will side with TE on a couple of elements here. CJ has thus far remained very quiet and his judgement must be called into question for his behavior. Doesn't mean he is necessarily guilty of any felonies. Heck, I dated a few "mistakes" back in my single days.

Where are you getting the "...accused Johnson of several felonies..." thing? I don't see it in TE's article, nor the article linked in it. Besides, as you pointed out, anyone can allege most anything to get an injunction--there's very little scrutiny at that level.

Violating an injunction is a crime unto itself, and as far as I know, the only one which CJ is facing--and violating of an inj'n has virtually nothing to do with the underlying allegations of the inj'n--it's a species of contempt. In fact, the injunction could be thrown out completely, and CG would STILL have to answer for the violation.

Conversely, he could be exonerated of the violation charge, while challenging and losing the injunction....and regardless what is alleged in the injunction, he would only have an injunction against him--no convictions--since the burden of proof is so much lighter (preponderence of the evidence vs. "beyond a resonable doubt" for criminal charges).

I just don't see a felony here.

Maybe it's just me.

Johnson was arrested for a misdemeanor - violating a temporary restraining order.

In order to obtain a temporary restraining order, his ex-girlfriend accused Johnson of several felonies, including rape, which is - at this point - heresay.

Does this make sense now?

Also note, he violated this order when he rode the same bus as her to class....not really the pin her in the corner at the party violation you would think.

Also, isn't this story like a week and half old? TE...couldn't find the words to make it mold together?

I'm not putting lipstick on a pig, TE - but I am trying to put a dose of reality on your article which is filled with fantasy and innuendo while remaining very limited on facts. (As always, you remain among my favorite writers of fiction, especially when the subject is the Gators.) Please read the last paragraph of my first post as evidence for my concern.

Frankly, I don't know why Carl hasn't offered a defense yet and if you're being honest and factual, neither do you. I suppose in TE-WORLD we need only hear from the prosecution and if the defense does not immediately shout their innocence, OFF WITH HIS HEAD!

I like the way you placed quotes around "much tougher" as though you are asserting that I had ever stated this. More great fiction from TE!!

If this were some psycho ex-girlfriend, then Johnson should've fought the first restraining order, and/or filed libel charges against her, or public defamation of character charges against her in order to clear his good name.

That he didn't protest tells me:

1.) Carl Johnson's not a smart feller (But hey...He's smarter than any LSU player, since your academic requirements are "much tougher")

2.) He doesn't care (In which case, see #1)

Either way, don't try putting any lipstick on that pig, RG...
